1. Acceptance of Terms
These Terms of Use form an agreement between you and Kjølberg Productions ("we", "us"), the owner and provider of the StudentHub application. StudentHub is a product developed and operated by Kjølberg Productions. By downloading, accessing or using StudentHub, you agree to be bound by these Terms. If you do not agree, do not use the app.
StudentHub is rated 4+ and may be used by people of any age. If you are a minor under the law of your country, you may use StudentHub only with the permission of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for any purchases made through the Apple Account associated with the device.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use StudentHub on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service and these Terms. This licence does not transfer ownership of the app or any intellectual property in it.
3. Use of the App
You agree to use StudentHub responsibly and lawfully. You must not:
Violate any applicable local, national or international law.
Use the app to store, produce or distribute unlawful material.
Reverse engineer, decompile, disassemble or attempt to derive the source code of the app, except to the extent this restriction is prohibited by applicable law.
Circumvent, disable or interfere with security-related features, including subscription entitlement checks.
Use automated means to access the app in a way that places unreasonable load on any connected service.
Failure to comply may result in termination of your licence.
4. Your Content
You retain all ownership of the content you create in StudentHub — your notes, recordings, files, boards, flashcards and other study material.
We do not receive, host, access or process your content. It is stored on your device and, if you enable it, in your own private iCloud account. We therefore claim no licence over your content, and we cannot recover it for you if it is lost.
You are solely responsible for your content, including for ensuring that you have the right to record lectures, upload documents and use any third-party material. Recording lectures or conversations may require the consent of those involved and may be restricted by law or by your institution's rules. It is your responsibility to check and comply with those rules.
5. Subscriptions and Payment
StudentHub offers optional auto-renewing subscriptions ("StudentHub Pro"), available as a six-month or twelve-month plan.
Payment is charged to your Apple Account on confirmation of purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the price then in effect.
You can manage or cancel your subscription in your Apple Account settings. Deleting the app does not cancel a subscription.
Any unused portion of a free trial is forfeited when you purchase a subscription.
All purchases are made through Apple. Refunds are handled by Apple in accordance with its policies, and we cannot issue refunds directly.
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a purchase within 14 days without giving a reason. Because digital content is supplied immediately, this right may be lost once you begin using the paid features, where you have expressly agreed to that. Withdrawal requests for App Store purchases are handled by Apple.
6. Availability and Changes
We may modify, suspend or discontinue any part of StudentHub, including individual features, at any time. Some features depend on Apple technologies — including Apple Intelligence, iCloud and on-device speech recognition — which may not be available on every device, in every region, or in every language, and which Apple may change or withdraw. We are not responsible for such changes.
7. Disclaimer of Warranties
To the fullest extent permitted by law, StudentHub is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the app will be uninterrupted, secure or error-free, that transcriptions or AI-generated study material will be accurate or complete, or that your data will not be lost.
AI-generated content is produced by an automated system and may be incorrect. Do not rely on it as a sole source for examinations, assessments or any decision of consequence. You remain responsible for verifying your study material.
You are responsible for maintaining your own backups. The app provides an export function for this purpose.
Nothing in this section limits any warranty or right that cannot be excluded under the law of your country of residence.
8. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, study material, academic outcomes or goodwill, arising out of or in connection with your use of StudentHub, whether based on contract, tort, negligence or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms will not exceed the greater of (a) the amount you paid us for StudentHub in the twelve months preceding the event giving rise to the liability, or (b) EUR 50.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, your statutory rights are not affected.
9. Termination
You may stop using StudentHub at any time by deleting the app. We may terminate or suspend your licence without notice if you materially breach these Terms or if required by law. On termination, your right to use the app ceases; content stored on your device and in your iCloud account is unaffected and remains yours.
10. Apple
These Terms are between you and us, not with Apple. Apple is not responsible for StudentHub or its content, and has no obligation to provide maintenance or support. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Governing Law and Disputes
These Terms are governed by the laws of Norway, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Norway, with Trøndelag District Court as the agreed venue at first instance.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of that country. Consumers in the EEA may also use the European Commission's Online Dispute Resolution platform.
12. Changes to These Terms
We may revise these Terms from time to time. Where changes are material, we will give reasonable notice in the app or by other appropriate means before they take effect. Continued use of StudentHub after the changes take effect constitutes acceptance.
13. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding StudentHub.
